अनैतिक संबंधातून मित्राचा खून केला, मित्रच आजन्म गजाआड जाऊन बसला
मयताची पत्नी व मुलाला न्याय मिळाला, कोर्टाने ७५ हजारांचा दंड सुनावला

विधवा बहिणी सोबत अनैतिक संबंध असल्याच्या कारणावरून आपल्या मित्राचा बियरची बाटली आणि दगडाने ठेचून खून करणाऱ्या विशाल उर्फ सायबा सुरवसे (वय २३, रा. आदर्श नगर, शेळगी) याला जन्मठेप आणि ७५ हजार रुपये दंड अशी शिक्षा जिल्हा सत्र न्यायाधीश आर. एन. पांढरे यांनी शुक्रवारी ठोठावली. दंडाच्या वसूल रकमेतून ५० हजार रुपये मयताची पत्नी आणि २५ हजार रुपये मयताच्या लहान मुलास नुकसान भरपाई देण्याचेही आदेशात नमूद आहे. मयत व आरोपी हे मित्र होते. मित्राचा खून करणाऱ्या मित्राला सजा मिळाली.
नितीन नागनाथ उबाळे (वय ३२ रा. भीमनगर, शेळगी) असे मयताचे नाव आहे. २६ मार्च २०२१ रोजी रात्रीच्या सुमारास त्यांचा शेळगी येथील महालक्ष्मी सोसायटीच्या पाठीमागे नागोबा मंदिरा समोरच्या मैदानात खून झाला होता. या घटनेतील मयत नितीन उबाळे हा विवाहित असून तो महापालिकेत कंत्राटी काम करत होता तर आरोपी विशाल सुरवसे हा त्यांच्या लांबचा नातेवाईक असून तो देखील शेळगी परिसरात राहण्यास होता. आरोपीच्या विधवा बहिणीसोबत नितीन उबाळे याचे अनैतिक संबंध होते, त्यामुळे विशाल हा नितीन याच्यावर चिडून होता. या कारणावरून पूर्वी त्यांच्यात तक्रार देखील झाली होती. घटनेच्या दिवशी म्हणजेच २६ मार्च २०२१ रोजी महापालिकेत काम न लागल्याने नितीन उबाळे हा कांद्याच्या पिशव्या घेऊन मार्केट यार्ड येथे कांदे विकण्यास गेला होता. रात्री घरी न आल्याने त्याचे भाऊ महेश यांनी फोन लावला. त्यावेळी नितीन यांनी आपण मार्केट यार्ड येथे असून घराकडे येतो, असे सांगितले होते. मात्र, तो रात्री आलाच नाही. २७ मार्च रोजी सकाळच्या सुमारास नितीन उबाळे यांचा मृतदेह शेळगी परिसरातील नागोबा मंदिरासमोरील मैदानात खून केलेल्या अवस्थेत आढळून आला. मृतदेहाजवळ मयताची दुचाकी आढळली होती. या घटनेची फिर्याद मयताचे बंधू परशुराम उबाळे (रा. भीमनगर, शेळगी) यांनी जोडभावी पेठ पोलिसात दाखल केली. त्याप्रमाणे पोलिसांनी विशाल सुरवसे यांच्या विरुद्ध खूनाचा गुन्हा दाखल करून अटक केली. तत्कालीन पोलीस निरीक्षक बाळासाहेब भालचिम यांनी या प्रकरणाचा तपास करून दोषारोपपत्र न्यायालयात दाखल केले होते.
या खटल्यात सरकार पक्षातर्फे एकूण १३ साक्षीदार तपासण्यात आले. प्रत्यक्ष दर्शनी पुरावा नव्हता. घटनेच्या दिवशी आरोपी आणि मयत या दोघांनी फ्रुट बिअरच्या बाटल्या विकत घेतल्या होत्या. दारू पिऊन हॉटेलमध्ये जेवण करताना तसेच दुचाकीवरून दोघे जाताना काही लोकांनी पाहिले होते. त्या साक्षीदारांची साक्ष मयत आणि आरोपी यांच्या कपड्यावरील रक्ताचे डाग, परिस्थितीजन्य पुरावा, फिर्यादीची साक्ष आणि सरकार पक्षाने मांडलेला युक्तिवाद ग्राह्य धरून न्यायालयाने आरोपीला जन्मठेप आणि एक हजार रुपये दंड अशी शिक्षा सुनावली. तसेच मयताची पत्नी पूजा उबाळे यांना ५० हजार रुपये तर मुलगा आनंद उबाळे (वय ५ वर्ष) याला २५ हजार रुपये नुकसान भरपाई देण्याचा आदेश आरोपीला दिला. या खटल्यात सरकारतर्फे जिल्हा सरकारी वकील प्रदीपसिंग राजपूत तर आरोपीच्या वतीने ॲड. गणेश पवार आणि ॲड. शेंडगे यांनी काम पाहिले.
