सर्वोच्च न्यायालयाने संकल्प डोळस यांस दिलेल्या आदेशा अनुसार उत्तम जानकर यांच्यासारख्या धनगर जातीच्या (इतर मागास प्रवर्गातील) व्यक्तींकडून खाटीक जातीच्या (अनुसूचित जातीच्या) व्यक्तींना मिळणाऱ्या लाभांवर अतिक्रमण करण्याच्या प्रवृत्तीस रोखण्यासाठी श्री. संकल्प डोळस यांची मा. मुंबई उच्च न्यायालयात पुनर्विलोकन याचिका !!!

स्वत:च्या जातीशी इमान न राखणाऱ्या-विरुद्ध श्री. संकल्प डोळस यांची न्यायालयीन लढाई !!

१. माननीय सर्वोच्च न्यायालयाने सन २०२२ च्या डायरी क्रमांक ३५९७ मध्ये श्री. संकल्प डोळस यांस माननीय मुंबई उच्च न्यायालयात पुनर्विचार याचिका दाखल करण्याची मुभा दिली. त्यानुसार, सन २०१४ च्या याचिका क्रमांक ४०६९ मध्ये दिलेल्या दि. २५ सप्टेंबर २०१९ रोजीच्या निकालाचा पुनर्विचार करण्यासाठी याचिका दाखल करण्यात आली आहे.

२. २५ सप्टेंबर २०१९ च्या निकालाचा व अंतिम आदेशाचा फेरविचार करण्याची पुरेशी कारणे आहेत. अंतिम आदेशाचा फेरविचार जी पुरेशी कारणे आहेत; ती, खालीलप्रमाणे आहेत:

अ. भारतीय राज्यघटनेच्या कलम २२६ अन्वये आणि कलम २२७ अन्वये माननीय उच्च न्यायालय हे जात पडताळणी समितीसाठी कायद्याने राखीव केलेल्या सत्यशोधनाच्या क्षेत्रात प्रवेश करू शकते का ?

आ. महाराष्ट्र अनुसूचित जाती, अनुसूचित जमाती, विमुक्त जमाती (विमुक्त जाती), भटक्या जमाती, इतर मागासप्रवर्ग आणि विशेष मागास प्रवर्ग (जात प्रमाणपत्र अधिनियम, २००० जारी करणे व पडताळणी चे नियमन) अंतर्गत तयार करण्यात आलेल्या नियमावलीच्या नियम १७ (११) मध्ये नमूद केल्याप्रमाणे कायद्याच्या योग्य प्रक्रियेचे पालन न करता जात प्रमाणपत्राची पडताळणी करता येते का? म्हणजेच, सन २००० च्या कायद्याच्या कलम ८ मध्ये नमूद केल्याप्रमाणे वस्तुस्थिती सिद्ध केल्या-शिवाय जात प्रमाणपत्राची पडताळणी करता येईल का?

इ. सन २००० च्या अधिनियमच्या नियम १७ (११) व कलम ८ अन्वये विचारात घेतलेली वैधानिक प्रक्रिया टाळणे कायद्याने शाश्वत आहे का?

ई. विशेषत: माळशिरस मतदारसंघ अनुसूचित जातीसाठी राखीव झाल्यानंतर प्रथम ‘धनगर’ जातीचा (इतर मागासप्रवर्ग) लाभ घेणाऱ्या इसम नंतर स्वत:ला ‘खाटीक जातीचा (अनुसूचित जाती) असल्याचा दावा करू लागलेल्या व्यक्तीला वैधता देता येत का?

उ. जर, राज्य सरकारने सादर केलेले रेकॉर्ड, श्री. संकल्प डोळस यांस हजर असून देखील सुनावणी दरम्यान दाखविण्यात आले नाही; तर, संकल्प डोळस यांना याचिका क्रमांक ४०६९ सन २०१४ च्या याचिके-मध्ये ‘प्रभावी सुनावणी’ देण्यात आली होती का?

ऊ. विशेषत: सुनावणीच्या तारखेला मा. मुंबई उच्च न्यायालयाच्या एकलपीठाचा मंच उपलब्ध असताना; अपीलीय बाजू नियमावलीच्या नियम १७ अध्याय १८ च्या अनुषंगाने स्थानिक कायदा/ राज्य कायद्यांतर्गत स्थापन करण्यात आलेल्या अर्धन्यायिक प्राधिकरणापासून निर्माण झालेल्या रिट याचिकेवर सुनावणी करण्याचा अधिकार या माननीय द्वि-सदस्यीय न्यायालयाच्या खंडपीठाला आहे का?

३. श्री. संकल्प डोळस हे पुनर्विचार याचिकाकर्ते हरकत घेणारे अर्जदार आहेत. श्री. संकल्प डोळस हे मूळ प्रतिवादी- हनुमंतराव डोळस यांचे कायदेशीर वारसदार म्हणून श्री. उत्तम जानकर यांच्या जातीच्या दाखल्याच्या याचिकेमध्ये दिवाणी अर्ज दाखल केला. श्री. हनुमंतराव डोळस यांचा मृत्यू सन २०१४ सालची रिट याचिका क्रमांक ४०६९ प्रलंबित असताना झाला.

४. सध्याच्या पुनर्विचार याचिकेला जन्म देणारी तथ्ये, परिस्थिती आणि कारणे खालीलप्रमाणे आहेत –

अ. श्री. उत्तम जानकर यांनी डिसेंबर २००७ मध्ये वेळापुर ग्रामपंचायतीच्या दोन जागांसाठी निवडणूक लढवली – श्री. उत्तम जानकर हे धनगर-जातीचे आहेत या कारणास्तव नागरिकांच्या मागासप्रवर्गासाठी राखीव जागेवरून निवडणूक लढविळी होती. तसेच, खुल्या प्रवर्गासाठी ठेवण्यात आलेल्या जागेवरून देखील श्री. उत्तम जानकर यांनी निवडणूक लढविली होती. श्री. उत्तम जानकर दोन्ही मतदारसंघातून निवडून आले होते. त्यानंतर श्री. उत्तम जानकर मागासवर्गीय प्रवर्गासाठी राखीव असलेल्या जागेचा राजीनामा देऊन सर्वसाधारण प्रवर्गाची जागा कायम ठेवली.

आ. माळशिरस मतदारसंघातून अनुसूचित जातीसाठीच्या लोकांसाठी राखीव असल्याने; माळशिरस मतदारसंघातून निवडणूक लढविण्याच्या महत्वकांक्षेमुळे, श्री. उत्तम जानकर स्वत: खाटीक समाजाचे असल्याची बतावणी करू लागले.

इ. श्री. हनुमंत राव डोळस यांनी दि. २० फेब्रुवारी २००९ रोजी समिती क्रमांक १, पुणे येथे अपील/तक्रार दाखल करून श्री. उत्तम जानकर यांच्या खाटीक जातीच्या दाखल्याला आव्हान दिले.

ई. श्री. उत्तम जानकर २००९ ची रिट याचिका क्रमांक ४३४५ दाखल करून पुणे येथील समिती क्रमांक १ ला या तक्रारीची दखल घेण्याचा अधिकार नाही, असे जाहीर करावे, अशी मागणी केली. ही रिट याचिका श्री. उत्तम जानकर यांनी मागे घेतली.

उ. श्री. उत्तम जानकर हे ‘खाटीक’ जाती (अनुसूचित जाती) संबंधित असल्याचा दावा जात पडताळणी समितीने २४ मार्च २०१४ रोजी अमान्य केला होता. त्यामुळे, सन २०१४च्या रिट याचिका क्रमांक ४०६९च्या आधारे, श्री. उत्तम जानकर यांचेकडून दिलेल्या आदेशाच्या वैधतेवर आणि औचित्यावर प्रश्न उपस्थित करण्यात आले होते. परंतु, सदरची याचिका मा. उच्च न्यायालयाने मंजूर केली.

ऊ. त्याविरुद्ध, श्री. संकल्प डोळस यांनी मुंबई उच्च न्यायालयाच्या आदेश यांच्या विरुद्ध मा. सर्वोच्च न्यायालयात दाद मागितली. या प्रकरणाची काही वेळ सुनावणी मा. सर्वोच्च न्यायालयाने घेऊन; श्री. संकल्प डोळस यांस मा. उच्च न्यायालयात सन २०१४च्या रिट याचिका क्रमांक ४०६९च्या आदेशाचे पुनर्विलोकन करावे; अशी मागणी करण्याची मुभा दिली.

ऋ. सन २००१ च्या अधिनियम २३ च्या कलम ८ नुसार श्री. उत्तम जानकर यांनी स्वत: हिंदू-खाटीक आहेत; हे जात पडताळणी समोर शाबीत करणे गरजेचे होते. परंतु, २५ सप्टेंबर २०१९ रोजीचा वादग्रस्त निर्णय व अंतिम आदेश २०१४ च्या रिट याचिका क्रमांक ४०६९ मध्ये देण्यात आला; नियमांच्या नियम १७ (११) अन्वये २००० च्या कायद्याच्या कलम ८ अन्वये विचारात घेतलेली वैधानिक प्रक्रियेस टाळण्यात आले.

ऌ. महाराष्ट्र अनुसूचित जाती व अनुसूचित जमाती विमुक्त जमाती (विमुक्त जाती), भटक्या जमाती, इतर मागासप्रवर्ग व विशेष मागास प्रवर्ग (जात प्रमाणपत्र देणे व पडताळणी चे नियमन) अधिनियम २००० च्या कलम ८ नुसार जात/जमातीचा दावा सिद्ध करण्याची जबाबदारी नेहमीच विशिष्ट जमातीशी संबंधित असल्याचा दावा करणाऱ्या व्यक्तीवर असते. या न्यायालयाने २००७ च्या रिट याचिका क्रमांक २५७६ वर सुनावणी करताना ९-६-२००७ देवराव उमरेडकर वि. महाराष्ट्र राज्य, मध्ये या बाबी विशेषतः हाताळल्या आहेत. स्वत:च्या जातीच्या दाव्याच्या पुराव्याचे व शाबीत करण्याचे ओझे दावेदारावर असते. ते श्री. उत्तम जानकर यांनी कलम ८ मधील कार्यपद्धती अनुसार पूर्ण केले नाही.

ऍ. श्री. उत्तम जानकर मान्य केल्याप्रमाणे – श्री. उत्तम जानकर धनगर-जातीचे आहेत,; २०१४ च्या रिट याचिका क्रमांक ४०६९ च्या निकालात असे नमूद केले गेले पाहिजे होते की – श्री. उत्तम जानकर स्वत: ला खाटीक-जातीचा असल्याचा दावा करण्यास मनाई आहे. श्री. उत्तम जानकर वतीने असा प्रयत्न, कायद्यास मान्य नाही. या माननीय न्यायालयाने २०२२ च्या आपल्या रिट याचिका क्रमांक १२७१३ मध्ये महाराष्ट्र राज्यातील जात पडताळणी प्रकरणांना अशा प्रकारचा सिद्धांत लागू केला आहे.. त्यामुळे सद्य:स्थितीत पुनर्विलोकन आवश्यक आहे.

ऎ. श्री. उत्तम जानकर सारख्या व्यक्तींना परवानगी दिली गेली, तर धनगर जातीच्या (इतर मागासप्रवर्गातील) व्यक्तींकडून खाटीक जातीच्या (अनुसूचित जातीच्या) व्यक्तींना मिळणाऱ्या लाभांवर अतिक्रमण करण्याचा प्रयत्न केला जाईल.

ए. त्यामुळे त्याचा सामाजिक परिणाम लक्षात घेणे आवश्यक होते की, राखीव असलेल्या लाभांमध्ये इतर मागासवर्गीय व्यक्तींनी केलेल्या अशा अतिक्रमणाच्या विषयात श्री. संकल्प डोळस हे स्वत: अनुसूचित जातीचे असल्याने श्री. संकल्प डोळस यांस विशेष स्वारस्य आहे आणि श्री. संकल्प डोळस यांचे कुटुंब त्यांच्या वडिलांच्या माध्यमातून श्री. उत्तम जानकर यांच्या अशा अतिक्रमण प्रवृत्तीस रोखण्यासाठी सक्रिय होते.

ऐ. न्यायालयीन प्रक्रियेत एखाद्या व्यक्तीची सुनावणी करण्यासाठी ‘प्रभावी सुनावणी’ आवश्यक असते. सध्याच्या प्रकरणात श्री. संकल्प डोळस यांस राज्य सरकारने सादर केलेल्या याचिके ज्या दस्तऐवजाचा आधार घेतला आहे, त्या दस्तऐवज बघण्याची संधी देण्यात आली नाही.

ऑ. एखाद्या पक्षकारांस कोणताही पुरावा न दाखवता किंवा जाहीर न करता, न्यायव्यवस्था जर त्याचा विचार करून निर्णय घेत असेल, तर तो निर्णय म्हणजे पक्षकरास त्याच्यावरील खटला चालवण्याची खरी आणि प्रभावी संधी नाकारण्यासारखे आहे. नैसर्गिक न्यायाच्या तत्त्वांवर विश्वास ठेवण्यासाठी ज्या कागदपत्रांचा आधार न्यायालयास घ्यावयाचा आहे त्यांचे योग्य प्रकटीकरण पक्षकारास करणे आवश्यक आहे. म्हणूनच, श्री. संकल्प डोळस यांस श्री. उत्तम जानकर यांच्या प्रकरणात खरी आणि परिणामकारक संधी देण्यात आली नव्हती.

ऒ. महाराष्ट्र अनुसूचित जाती, अनुसूचित जमाती, विमुक्त जमाती (विमुक्त जाती), भटक्या जमाती, इतर मागासप्रवर्ग व विशेष मागास प्रवर्ग (जात प्रमाणपत्र देणे व पडताळणी चे नियमन) जात प्रमाणपत्र कायदा, २००० हा स्थानिक कायदा/राज्य कायदा व जात पडताळणी समिती हा अर्धन्यायिक प्राधिकरण असल्याने जात पडताळणी समितीच्या आदेशाला आव्हान देण्याबाबतची सुनावणी या माननीय न्यायालयाच्या एकलपीठाने व्हायला हवी होती व त्यावर निर्णय घ्यायला हवा होता. मुंबई उच्च न्यायालयाच्या अपिलीय बाजू नियमावलीतील नियम १८ अध्याय १७. तथापि, या माननीय न्यायालयाच्या माननीय खंडपीठाकडे अधिकारक्षेत्र कसे आहे, विशेषत: जेव्हा या माननीय न्यायालयाचे माननीय एकलपीठ संबंधित सुनावणीच्या तारखेला कार्यरत होते. संबंधित निकालात याबाबत कोणतेही कारण दिलेले नाही. हा मुद्दा २०१४ च्या रिट याचिका क्रमांक ४०६९ मध्ये दिलेल्या २५ सप्टेंबर २०१९ च्या निर्णय आणि अंतिम आदेशाच्या मुळाशी जात आहे. २०१४ च्या रिट याचिका क्रमांक ४०६९ मधील २५ सप्टेंबर २०१९ च्या सध्याच्या निकालाचा आणि अंतिम आदेशाचा निर्णय देताना माननीय खंडपीठाने एकलपीठाचे अधिकार क्षेत्र ताब्यात घेण्याचे कोणतेही कारण नाही.

५. म्हणून श्री. संकल्प डोळस मा. उच्च न्यायालयास प्रार्थना करतात की:

अ. माननीय न्यायालयाने २०१४ च्या रिट याचिका क्रमांक ४०६९ मध्ये दिलेला २५ सप्टेंबर २०१९ चा निर्णय व अंतिम आदेश मागे घेऊन; संपूर्ण प्रकरण जात पडताळणी समितीकडे परत पाठवावे जेणेकरून श्री. उत्तम जांकर यांस महाराष्ट्र अनुसूचित जाती, अनुसूचित जमाती, विमुक्त जमाती (विमुक्त जाती), भटक्या जमाती, इतर मागासप्रवर्ग व विशेष मागास प्रवर्ग (वाटप व पडताळणी चे नियमन) जात प्रमाणपत्र अधिनियम, २००० चे कलम ८अन्वये ‘खटीक’ (अनुसूचित जाती) असल्याचा दाव्याबद्दल योग्य प्रक्रियेचे अनुसरण करून त्यावर निर्णय घेण्याचे निर्देश द्यावेत व श्री. उत्तम जानकर यांचा ‘खटीक’ जातीचे (अनुसूचित जाती) प्रमाणीकरण रद्द करावे..

आ. सध्याच्या पुनर्विचार याचिकेवर सुनावणी व अंतिम निकाल येईपर्यंत मूळ याचिकाकर्त्याला देण्यात आलेले खटीक जातीचे जात प्रमाणपत्र जप्त करून याचिकाकर्त्याला खाटीक जातीचे मूळ जात प्रमाणपत्र सोलापूर येथे जमा करण्याचे निर्देश द्यावेत तसेच खाटीक जातीसाठी मूळ याचिकाकर्त्याला दिलेले प्रमाणीकरण स्थगित ठेवण्यात यावे;

इ. या माननीय न्यायालयाला न्यायाच्या हिताच्या दृष्टीने योग्य व योग्य वाटेल असे अन्य आदेश किंवा आदेश पारित करा.
